      <title>HOMEBUYER TAX CREDIT CLOSING DEADLINE EXTENDED</title>
      <description>&lt;p&gt;&lt;strong&gt;HOMEBUYER TAX CREDIT CLOSING DEADLINE EXTENDED&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;From CMLA: After a close brush with the deadline, Congress has passed an extension of the Homebuyer Tax Credit closing deadline, the Homebuyer Assistance and Improvement Act (H.R. 5623). The &lt;strong&gt;extension applies only to transactions that have ratified contracts in place as of April 30, 2010 that have not yet closed.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The legislation is designed to create a seamless extension the &lt;strong&gt;new closing deadline for eligible transactions is now September 30, 2010&lt;/strong&gt;. There is will be no gap between June 30 and the date the President signs the bill into law. CML America worked closely with Congressional leaders on both sides of the aisle to enact this important legislation. Extending the Tax Credit Closing deadline will help provide additional stability to the housing market across the nation.&lt;/p&gt;
&lt;p&gt;Additionally, the United States Senate has passed the National Flood Insurance Program Extension Act of 2010 (H.R. 5569) an extension of the National Flood Insurance Program until September 30, 2010. This will allow transactions to move forward. The bill is retroactive and covers the lapse period from June 1, 2010 to the date of enactment of the extension.&lt;/p&gt; &lt;div class="agent_signature"&gt;

      <title>Family Reunion - A Good Time for Family Planning</title>
      <description>&lt;p class="style104"&gt;In this month's article from the National Care Planning Council, of which I am, we look at taking advantage of family gatherings to start the process of planning for mom and dad's future needs. THere is some good information here. Also, keep in mind, that while Long Term Care is expensive, there are ways to use the equity in their home to pay for these expenses. &lt;p class="style104"&gt;&lt;strong&gt;Family Reunion -- A Good Time for Planning&lt;/strong&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;Summertime brings a lot of family time. With family reunions, picnics, weddings and other events, long distant family members travel to gather together. It is also the perfect time to do some planning for the future. With parents aging and their health and lifestyles changing, children need to discuss some changes and decisions that will be needed in the near future. Parents should take the time to tell their children where important documents are kept and what their wishes are in the event of needing health care directives or experiencing long term care needs. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&lt;strong&gt;For those children who live away, the change they see in their parent's health and mental capacity may be alarming -- whereas siblings that have daily contact are working with these issues constantly. &lt;/strong&gt;Here is the chance to compare notes and work together as a complete family in the long term care planning process. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&lt;strong&gt;For you parents who are well and active, this is a good time to hold a family meeting and share with your children your plan for long term care&lt;/strong&gt;. Tell them where financial and legal documents are located. Review health care directives, living wills and long term care alternatives. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&lt;strong&gt;Experience has shown that even families that are close can quickly grow angry, jealous and hostile towards each other when an aging parent begins to need long term care.&lt;/strong&gt; If a sibling moves into the parent's home, others can easily be suspicious of ulterior motives and fear losing their inheritance. On the other hand, the child providing the elder care becomes bitter and feels there is no support or help from siblings. Pre-need meetings for the purpose of making a plan, before eldercare becomes imminent, avoids these types of conflicts. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;In its book, &amp;ldquo;&lt;strong&gt;The 4 Steps of Long Term Care Planning&lt;/strong&gt;,&amp;rdquo; the National Care Planning Council provides guidelines and checklists for family planning meetings. Here's an excerpt from the book: &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&amp;nbsp;&lt;/p&gt;
&lt;blockquote&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;ldquo;The first step to holding a meeting, and perhaps the most difficult &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;one, is to get all interested persons together in one place at one time. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;If it's a family gathering, perhaps a birthday, an anniversary or &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;another special event could be used as a way to get all to meet. Or &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;maybe even a special dinner might be an incentive. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;The person conducting the meeting can be a parent or one person of &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;a couple who are doing their planning, years before the need for care &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;arises. A meeting on behalf of someone already receiving care or &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;needing care in the immediate future could be conducted by that &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;person or by a member of the family, by an adviser or a friend. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;The agenda could be formal or informal. If you want a formal &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;agenda, we suggest using our care planning checklist as the agenda. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;Copies of the care plan should be prepared prior to the meeting and &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;presented to those attending. Discussion is encouraged and we &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;recommend that the person in charge not dictate but encourage input &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;from everyone. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;After a thorough discussion of the issues and the presentation of the &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;solutions to the problems that will be encountered, there should be a &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;consensus of all attending to support the plan. If the plan needs to &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;be altered to meet everyone's expectations then by all means do so if &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;that can be done. But it is not always possible to please everyone so &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;there must sometimes be compromise. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;The end of the meeting should consist of asking everyone present to &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;make his or her commitment to support the plan. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;strong&gt;&lt;span&gt;GET IT IN WRITING! All good intentions seem to be forgotten &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&lt;strong&gt;with time&lt;/strong&gt;. It may be years after this meeting before the long term &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;care plan begins. If there are vocal commitments to help with &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;transportation to doctors, give respite to the caregiver or other &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;commitments, write them down on the care agreement. You can &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;even have each person put a signature to his or her commitment if &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;you think that is important.&amp;rdquo; &lt;/span&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;span&gt;&amp;ldquo;No one wants to think about a time when they might need long-term care. So planning ahead for this possibility often gets put off. Most people first learn about long-term care when they or a loved one need care. Then their options are often limited by lack of information, the immediate need for services, and insufficient resources to pay for preferred services. Planning ahead allows you to have more control over your future&amp;rdquo;. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;&lt;a href="http://www.longtermcare.gov/"&gt;http://www.longtermcare.gov &lt;/a&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p class="MsoNormal style105"&gt;&lt;span&gt;"Whether you plan a formal meeting with an agenda or informally gather for a discussion, when the family is together make it a point to start the long term care planning process. &lt;/span&gt;&lt;/p&gt;
&lt;p class="MsoNormal"&gt;&lt;span&gt;There is a lot to learn and many decisions to make concerning finances, health issues and legal work.       <title>Oregon USDA Guaranteed Rural Home Loan</title>
      <description>&lt;p&gt;&lt;strong&gt;Oregon USDA Guaranteed Rural Home Loan&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;img title="USDA" src="http://activerain.com/image_store/uploads/7/0/5/0/2/ar127418280020507.jpg" height="138" alt="" width="200"&gt;Designed as a resource for low to moderate income homeowners in rural communities, the USDA Guaranteed Rural Home Loan has helped many Oregon families obtain financing for homes not only in rural areas, but also in cities such as Sherwood, Newberg, Wilsonville, Forest Grove, Canby, Coos Bay and Klamath Falls,&lt;/p&gt;
&lt;p&gt;While the USDA has guaranteed this loan, the money actually comes from traditional lenders like Golf Savings Bank. We underwrite the loan based on USDA guidelines and then sell it on the secondary market, just like a traditional loan.&lt;/p&gt;
&lt;p&gt;One of the most attractive characteristics of the USDA Guaranteed Rural Home Loan is that it is one of the last home loans with 100% financing. I have helped many home owners get into a home with no money down. In fact, they usually are able to get their Earnest Money back as well.&lt;/p&gt;
&lt;p&gt;The program also allows for 6% Seller Concessions to help cover the cost of the Buyers Closing Costs. Rates are very competitive with conforming and FHA loans, and there is no monthly mortgage insurance payment.&lt;/p&gt;
&lt;p&gt;The two main qualifiers of the USDA Guaranteed Rural Home Loan program are:&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;The Property must be within a qualified area. This is easy to determine based on a USDA online map.&lt;/li&gt;
&lt;li&gt;The Adjusted Household Income&amp;nbsp;must not make exceed&amp;nbsp;the published&amp;nbsp;income levels for the area. This takes a little more work as it is unique to the USDA. &lt;/li&gt;
&lt;/ol&gt;
&lt;p&gt;The loan is undergoing some changes right now. Traditionally, the USDA will provide financing up to 102% of the appraised value of the home. This covers the 2% Guarantee Fee that is mandated by Congress to help repay the cost of this program. Historically, this program runs out of money every year and then is funded again by Congress. Over the last 2 years, the program has exhausted it's funds in the Spring. Last year it was quickly funded, this year, not so. The program is currently out of funds and is awaiting Congressional funding.&lt;/p&gt;
&lt;p&gt;There is a Bill before Congress to make the USDA Guaranteed Rural Home Loan self-funding. This will enable the program to continue to exist without the need for Congress to continually allocate for funds. The Rural Housing Preservation and Stabilization Act increases the maximum loan guarantee fee that USDA's Rural Housing Service has authority to charge for new housing purchases from 2.0 to 3.5 percent and allows an annual fee of not more than 0.5 percent per year on the balance of the loan. This will result in a nominal&amp;nbsp;increased monthly payment of around $8 per $100,000 at 5% Interest Rate.&lt;/p&gt;
&lt;p&gt;A&amp;nbsp;modified version of the Rural Housing Preservation and Stabilization Act&amp;nbsp; has been added to &amp;nbsp;H.R. 4899, the Disaster Relief and Summer Jobs Act of 2010 and will hopefully be voted on soon.&lt;/p&gt;
&lt;p&gt;We are still accepting applications based on the 3.5% Guarantee Fee, underwriting them and then putting them in suspense until the USDA gives us further direction.&lt;/p&gt;
&lt;p&gt;If you need to close soon, I suggest using an FHA or conforming loan. If you have the luxury of waiting a few more weeks or months, than this is still the best loan on the market if you don't have 20% down payment and you and your property qualify.&lt;/p&gt; &lt;div class="agent_signature"&gt;

      <title>USDA to Issue Conditional Commitments</title>
      <description>&lt;p&gt;I just received the following update from the USDA regarding their popular USDA Guaranteed Rural Home Loan Program.&lt;/p&gt;
&lt;p&gt;"&lt;strong&gt;Fiscal Year 2010 Appropriated Funds -&lt;br&gt;&lt;/strong&gt;&lt;strong&gt;&amp;nbsp;Issuing Conditional Commitments once Appropriated Funds are Exhausted&lt;br&gt;&lt;/strong&gt;&amp;nbsp;&lt;br&gt;The Single Family Housing Guaranteed Loan Program (SFHGLP) will issue Conditional Commitments once currently appropriated funds for FY 2010 are exhausted.&amp;nbsp; Conditional Commitments will be issued "subject to the availability of funds and Congressional authority to charge a 3.5 percent guarantee fee for purchase loans and a 2.25 percent guarantee fee for refinance loans."&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The good news is that this means that business moves forward as usual, HOWEVER, note that these Conditional Commitments will be subject to a 3.5% guarantee Fee for purchases and a 2.25% fee on refinances. This might cause some problems with loans that have been submitted with a 2% guarantee fee. Looks like I'm on the phone to get clarification.....&lt;/p&gt; &lt;div class="agent_signature"&gt;

      <description>&lt;p&gt;I just received an email from the USDA regarding the status of Funding. Based on available, unobligated funds, they are looking at Funds exhausting around 5/7/2010. HOWEVER, since there are 2 Bills before Congress, and Congress is very aware of the situation, there is a chance that the USDA will once again issue Conditional Commitments.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;April 27, 2010&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;Notice of Funding&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;This message is to notify you of the unobligated balances of fiscal year 2010 program funding for the Single Family Housing Guaranteed Loan Program.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;As of April 27, 2010:&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;Purchase:&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; $1,046,482,690.77&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;Refinance:&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; $84,377,998.61&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;Total:&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; $1,130,860,689.38&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;We anticipate funding will likely be exhausted by May 7, 2010.&amp;nbsp; The Administration is aware of our funding shortfall.&amp;nbsp; Currently two Bills have been introduced in an effort to secure additional funding, H.R. 5003 and H.R. 5017.&amp;nbsp; The status of this proposed legislation is available to the public online at:&amp;nbsp; http://thomas.loc.gov/home/bills_res.html.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;&amp;nbsp;Depending upon Congressional activity with the proposed legislation it is possible that the Agency may consider issuing Conditional Commitments.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;This is good news. It looks like we will see this resolved soon. Now the question is will there be major or minor changes to this program? Will they affect existing loans with GUS Approvals but no commitment letter?&lt;/p&gt;

      <title>USDA Guaranteed Rural Home Loan Fees to Increase</title>
      <description>&lt;p&gt;Based on a couple of Bills that are before Congress, it looks like we can expect to see the USDA's popular Guaranteed Rural Home Loan program have increased UpFrontMortgage Insurance Fees in the very near future. According to an article in the &lt;a href="http://www.ncsha.org/blog/kanjorski-and-capito-introduce-bills-extend-usda%E2%80%99s-rural-home-loan-guarantee-program" title="USDA Guaranteed Rural Home Loans Fees to Increase"&gt;National Council of State Housing Agencies&lt;/a&gt;, two seperate Bills have been introduced to extend funding, AND to make it more self-sufficient. The Bills are in committee.&lt;/p&gt;
&lt;p&gt;Since this isn't a simple extension of funding, I would be surprised to see it passed soon. Hope I'm wrong. We also don't know the details. Will they continue to wrap the increased fees into the loan? Will it continue to be 100% financing? Will they continue to allow 6% Seller Concessions?&lt;/p&gt;

&lt;p&gt;On April 14, Congressman Paul Kanjorski (D-PA), Chairman of the House Financial Services Subcommittee on Capital Markets, Insurance, and Government Sponsored Enterprises, &lt;a href="http://kanjorski.house.gov/index.php?option=com_content&amp;amp;task=view&amp;amp;id=1759&amp;amp;Itemid=103"&gt;introduced&lt;/a&gt; the Rural Housing Preservation and Stabilization Act of 2010, H.R. 5017.&amp;nbsp; Housing and Community Opportunity Subcommittee Ranking Member Shelley Moore Capito (R-WV) &lt;a href="http://capito.house.gov/index.cfm?p=PressReleases&amp;amp;ContentRecord_id=5b5c5a36-54ab-4ec2-bcce-8b6d504a4a8a&amp;amp;ContentType_id=1fd4a434-0ac6-401b-912e-788b9296ed8e&amp;amp;77f2aefe-b697-4b42-a9ea-ffee1440e39e&amp;amp;Group_id=f4042c6e-6f9a-49f1-a709-9cfd5e746e69"&gt;introduced&lt;/a&gt; a similar bill, The Rural Housing Improvement Act,&amp;nbsp; H.R. 5003, on April 13.&amp;nbsp; Both bills would allow the Section 502 Single-Family Housing Guaranteed Loan Program to continue this year by increasing the annual commitment authority for the program, which USDA &lt;a href="http://www.ruralhome.org/storage/documents/502%20guar%20lender%20funding%20notice%203-9-10.pdf"&gt;reported&lt;/a&gt; earlier this year would be exhausted by the end of April.&amp;nbsp;&lt;br&gt;&lt;br&gt;Since this announcement, NCSHA and several other housing groups have been working with Congress and the Administration to extend the program.&amp;nbsp;&lt;br&gt;&lt;br&gt;To make the program self-funding and avoid the need for Congress to appropriate more funds for the program this year, Kanjorski's bill would increase the current 2 percent upfront fee to 3.5 percent.&amp;nbsp; It would also authorize the Secretary of the Department of Agriculture to assess an annual fee of 0.5 percent on the outstanding balance of the loan.&amp;nbsp; Capito's bill would allow the Secretary to increase the upfront fee to between 3 and 4 percent, based on what fee level would cover the program's costs.&amp;nbsp;&lt;br&gt;&lt;br&gt;Both bills have been referred to the House Financial Services Committee.&amp;nbsp; Committee Chairman Barney Frank (D-MA) stated that he hopes to bring up Kanjorksi's bill for consideration in the Committee as soon as possible.&amp;nbsp; Congressmen Ruben Hinojosa (D-TX), Paul Hodes (D-NH), Charles Wilson (D-OH), and Joe Courtney (D-CT) are co-sponsors of Kanjorski's bill."&lt;br&gt;&amp;nbsp;&lt;/p&gt;
